1. Ownership of the website
The website http://www.armatek-custom.com (hereinafter Website) is owned by ARMATEK Custom Lures Engineering di Giulio Fait, registered office in Via Marsala 46, 33100 Udine (UD), ITALY (VAT 01164960310, REA UD -289914, Tax Code FTAGLI76H23E098D), and it is aimed at the on-line sale of sports products and services.
2. Applicable legislation
The buying and selling of products and services by electronic means is regulated by Legislative Decree 6 September 2005 n. 206 (Consumer Code) in respect of distance sales with consumers, Legislative Decree 9 April 2003 n. 70 relating to electronic commerce , by Legislative Decree 21 February 2014 n. 21 , as amended.
The purchase contract between the Customer and ARMATEK Custom Lures Engineering will be governed by and interpreted in accordance with the Italian Law.
3. Acceptance of the general sales conditions
By placing an order in the manner provided in the Webite , the Customer declares to have read all the information provided during the purchase procedure and accepts the general conditions of sale and payment transcribed below.
These general conditions of sale, together with the conditions regarding the method of delivery and payment of goods, as well as legal notices, form an integral part of the sales contract concluded between the Customer and ARMATEK Custom Lures Engineering.
Therefore ARMATEK Custom Lures Engineering invites the Customer to carefully read these general conditions of sale, in print or otherwise save a copy. The Customer will receive confirmation of the contract concluded before the execution of the service starts (PDF file) or, at the latest, at the time of delivery of goods (paper).

In order to make a purchase it is necessary that the Customer is registered within the Website.
It’s a Customer responsibility to provide ARMATEK Custom Lures Engineering the data required at registration in proper shape and free of errors and/or omissions, which is necessary for the conclusion of the contract.
At a time when the purchase is made, the Customer has the option to choose the preferred mode of delivery and payment of the product. The payment is always intended, with each mode and for each type of product, anticipated.
The acceptance of the order by ARMATEK Custom Lures Engineering is confirmed by sending a confirmation e-mail to the e-mail address communicated by the Customer at the time of registration on the Website.
ARMATEK Custom Lures Engineering reserves the right, at its sole discretion, to refuse the order .

6. Delivery
The times of production of goods, produced according to the instructions of the Consumer, depend on the realization complexity, level of personalization chosen by the Customer, as well as the amount of work that ARMATEK Custom Lures Engineering is subject to at the time of the order.
In the interests of absolute transparency and fairness, ARMATEK Custom Lures Engineering has developed a tool, called Work-Meter (displayed in the Front-office of the Website), suitable to effectively quantify the maximum waiting time expected for the realization of the products, starting from the receipt of payment.
To this waiting time it must be added the shipping time, independent of ARMATEK Custom Lures Engineering.
The Work-Meter is daily updated, based on the amount of accumulated work and the estimated time to process orders. A description of the waiting time related to the working level indicated by the Work-Meter follows.

The Customer will be notified, by e-mail, about the actual timing of custody of the goods to the Courier, upon receipt of payment.
ARMATEK Custom Lures Engineering, in accordance with the Consumer Code, is committed to the execution and delivery of the goods at the latest within 30 ( thirty) days from the date of conclusion of the contract. That date, for legal purposes of these general conditions of sale, corresponds to the date of receipt of payment.
7. Security & Privacy – Privacy Policy
In order to access and navigate the ARMATEK Custom Lures Engineering Website, no registration is required.
Instead, Customers must leave details at the time of registration to the Website when they decide to purchase.
In this case the Customer will be asked to leave the information strictly necessary for the purchase and delivery of the product.
These data can be changed by the Customer at any time by clicking on My personal info located in the navigation bar on the bottom of the screen; clicking on My Account located in the navigation bar on the bottom of the screen or directly on the personal Username, located at the top right on the main page.
8. Administrative and judicial remedies
Subject to the jurisdiction of ordinary courts, it is also subject to the possibility to make use of extra-judicial settlement of disputes relating to the ratio of consumption, from the entities formed by the Chambers of Commerce, Industry, Handicrafts and Agriculture.
9. ADR/ODR
The legislation about Alternative Dispute Resolution (ADR) and Online Dispute Resolution(ODR) enables Consumers and professionals to resolve disputes without the need for lengthy and costly legal proceedings. The ODR allows the Customer to file a complaint online at any of the 23 official EU languages. The ODR platform transmits only complaints to ADR entities approved by Member States.

10. Jurisdiction
For the resolution of any civil disputes arising from the interpretation, execution and termination of this sale contract, if the Customer is a consumer (i.e. an individual who buys products for purposes not related to his professional activity) the imperative local jurisdiction is the judge of the place of residence or domicile of the consumer himself, if located in Italy (Art. 66-bis of Legislative Decree 21 February 2014, n. 21).

These general conditions of sale shall remain valid and enforceable until they are amended and/or supplemented by ARMATEK Custom Lures Engineering.
Changes and/or additions will be effective from the date of publication of the same on the Website http://www.armatek-custom.com.
12. The on-line purchase
Cart
To buy a product you must add it to the Cart.
To do this simply click on the button Add to cart.
This symbol is on the right side of the category page, or on the right side under the product name when you are inside the product page.
The purchase of products "Custom and/or Ready Made" needs the integration of customization data and saving them, within a launching board, at an earlier stage before the Cart addition. The data and methods of insertion of the same, within the product customization box, are contained in the ARMATEK Catalog, that can be downloaded for free, after registration. The product customerization process is eased by Designer Sheets, available for free at the Download section of the product page.
Enter a cart does not commit to the purchase.
Once the product is inserted into the cart, the Customer will gain access to a page where the amount of each product to be purchased can be changed or the item can be deleted from the cart by clicking on the appropriate button.
At this stage, the Customer can also see the shipping costs.
In order to view other products, simply click on Continue shopping at the bottom left and then click the corresponding category or enter data(if you already know the product) in the search menu at the top.
The products in the shopping cart will be stored for a week. After that time, the cart will be emptied. If during this period the price of the products is varied, or the product becomes unavailable, the cart will automatically update the price by changing or eliminating the product no longer available.

From any page of the Website the Customer can reach directly to the shopping cart and check its content; just click on "Shopping Cart" at the top of the upper navigation bar.
Exceptionally it is possible that, upon insertion of a product in the shopping cart or in the order summary, it appears the message "The product is temporarily out of stock"; this drawback is due to the fact that there is a short interval of time between the periodic update of the catalog and the moment when the products are exhausted. In other words, the product introduced in the basket was terminated at the time of its inclusion, but the catalog had not yet been updated.
Orders
To make a purchase on the online store Website the Customer must register and make an order. For each order created a unique identifier is assigned (reference number): any communication regarding the same order will be identified by this unique reference.
Confirmation of the order is given within the final page of confirmation (on the Website) and by e-mail (to the address indicated during registration).
There are no minimum or maximum limits of products or amounts for each individual order.
Other time each order (even within the same day) assumes different “states”.
Inside the My orders page the state of the order can be checked at any time.

Registration
In order to complete a purchase the Customer needs to register on the Website, and enter the necessary information for the invoice and delivery. Data will be stored in such a way that once made the first purchase, in order to proceed with another order the Customer will be simply asked to enter the previously chosen username and password. This data, subject to the data protection law (Legislative Decree no. 196/2003), can be changed by the Customer at any time by clicking on My Account located in the navigation bar on the bottom of the screen or directly on the username, located at the top right of the main page.
From a practical standpoint, the registration, which is not binding in any way to the purchase, will be prompted after the Customer enter a product in the shopping cart and click on the Proceed to checkout button. This way it will come to an identification page where, in the case of new customer, it will be required to register with the Website, and if already registered, it will be prompted to enter the username and the password chosen at the time of registration.
In the case of new Customer You will be directed to the registration form. After completing the registration form it will be possible to proceed with the order.
Registering is beneficial: in addition to not having to enter Your data in the event of subsequent purchases, You can proceed to download the catalog. Also, if You wish, You can receive timely information on new products, Website updates and rebate offers, simply giving Your consent to receive our periodic newsletter.
Nota bene
Registration is necessary and sufficient condition to download the ARMATEK Catalog. In contrast, Designer Sheets, available in the download area of Custom and Ready Made products, do not require any registration. They are still protected by copyright.
Invoice
Faced with each order completed, ARMATEK Custom Lures Engineering will invoice with the data provided by the Customer when ordering.
To download the invoice in PDF format:
- Access to the My Account section by entering the username and password with which you placed the order
- Identify the order concerned
- Select the PDF file under the heading Invoice
The invoice is available only after payment is accepted.
Payment forms
Credit card
ARMATEK accepts major credit cards, including prepaid and rechargeable: Visa, Mastercard, Diners Club, American Express and JCB.
With payment by credit card (Setefi Virtual POS) Customers will not be charged any type of supplement.
The Electronic Commerce System guarantees the payment protocols Verified by Visa and MasterCard SecureCode (3D Secure) that make the Customer better protected against problems arising from fraud and disputes. The use of 3D Secure protocol improves security controls on the transaction: the owner, if he is in possession, must enter a user code and password that verifies the identity (issued on delivery of the physical card).
During check out, finally, it is compulsorily required the insertion of the security personal code printed on the card:
• CVV2 (Visa)
• CVC2 (MasterCard)
• 4DBC (American Express)
For all the credit cards it is necessary to enter the personal security code otherwise the order is canceled. For the circuit Visa, Mastercard and Diners security code is the last 3 digits found on back of card, while for American Express cards the code is 4 digits and is located on the front of the card of credit.
Nota bene
It may happen that, after entering the data of the credit card and the security code, an additional code or some specific data will be asked. This is because some banks require precise procedure to enable the use of on-line credit card. To find out how to enable credit card to shop online or to know the code to enter You need to contact Your credit card company or Your bank.
When the cardholder makes a purchase and confirms the payment, it is redirected by the ARMATEK Custom Lures Engineering’s Website to the payment page owned by Setefi. This allows you to exempt ARMATEK Custom Lures Engineering from security issues related to sensitive data of the Holder. ARMATEK Custom Lures Engineering will never see the card security code or the entire number of the credit card.
Inside the Setefi portal the Holder will be asked to enter:
• number of credit card,
• expiry date of the credit card,
• personal security code (CVV2, CVC2, 4DBC according to the paper)
• fill in the field for entering the e-mail address of the Cardholder.
Once the transaction is completed, the Cardholder is redirected to the merchant's Website for viewing the outcome. Upon completion of the transaction, the Customer will receive, via e-mail, a notification of the same (virtual ticket).
Before being given to the Courier, the order paid by credit card may be subjected, directly with the relevant banking institution, to a " security verification" (verification that ensures the actual ownership of the credit card) .
In the case of a "security verification" the customer is notified by ARMATEK Custom Lures Engineering via e -mail.
This check requires an average of:
- 24 hours for orders placed by credit card of Visa and Mastercard circuits;
- 2 Days for orders placed with Amex and Diners credit card circuit for amounts exceeding € 400.00.
If the bank communicates to ARMATEK Custom Lures Engineering any irregularities concerning the use of credit card, ARMATEK Custom Lures Engineering will proceed with the cancellation of the order given notification via e -mail.
Bank transfer
ARMATEK Custom Lures Engineering accepts bank transfer as a form of payment.
With payment by bank transfer the Customer will not be charged any type of supplement.

The banking practice involves that the transfer made is credited to the beneficiary's bank account (ARMATEK Custom Lures Engineering di Fait Giulio) not before 3/5 working days from its execution.
At any time after 7 working days from the date of acceptance (the date when You receive an order confirmation via e-mail), without having received the credit of the bank transfer, ARMATEK Custom Lures Engineering will cancel the order, giving simultaneous notice through e-mail.
13. Delivery
General description of the service
ARMATEK Custom Lures Engineering accepts orders requiring the delivery in the following countries:
European Union (all), Iceland, Liechtenstein, Norway, Switzerland, U.S.A., Japan, Canada.
ARMATEK Custom Lures Engineering confirms acceptance of the order by sending an automatic summary e-mail to the e-mail address specified by the Customer during the registration process.
ARMATEK Custom Lures Engineering prepares the goods contained in the order and entrust them to the Courier with original and sealed packaging and with cardboard boxes properly closed.
The timing of assignment of the products to the Courier is published in the section Delivery to the Courier (hereinafter "Assignment to the Courier") and vary depending on the mode of payment and the type of product purchased.
Deliveries are made on working days, Monday through Friday, except holidays (hereinafter "Business Days/s"). For hours it means the hours included in Business Days.
ARMATEK Custom Lures Engineering uses the following carriers : Poste Italiane, SDA.
Times of delivery by the Courier to the Customer's residence are detailed in the section Times, types and delivery costs and still be indicative as they can vary due to major force, for difficult to traffic conditions and road conditions, to strikes or by Authority act.
The delivery costs are charged to the Customer and they are detailed in each "type of delivery" choice.
Regardless of the delivery costs, any order is subject to a charge of € 3.00 (including VAT) to cover administrative costs, packing and CONAI contribution, supported by ARMATEK Custom Lures Engineering.
Upon delivery of the goods by the Courier the Customer is required to check:
Once signed the delivery note of the Courier, the Customer may not make any objection about the quantity and quality of what has been received (Art. 63 Legislative Decree 21 February 2014, n. 21).
Delivery to the Courier
The timing of assignment of the products to the Courier vary depending on the method of payment, product availability and the type of product chosen.
o 24 hours for orders placed by credit card Visa and Mastercard circuit;
o 2 Days for orders placed with the circuit Amex and Diners credit card for amounts exceeding € 400.00.
Orders containing personalized products (marked on the site as Custom and/or Ready Made) are entrusted to the Courier within a period of time which can range from 5 to 25 Business Days and in any case detailed in the Website through the Work-meter.
ARMATEK Custom Lures Engineering confirms the assignment of the order to the Courier by sending an e-mail to the Customer.
Delivery to the Courier of Customerized Products
Customerized (personalized) products are products that are not in stock (marked on the site as Custom and/or Ready Made). For logistical needs of ARMATEK Custom Lures Engineering, they are made only as a result of the order, and only after receiving accreditation by the Customer.
Customerized products are identified by the following icons:
Time of assignment to the Courier: it takes between 5 to 25 Business Days for the realization of goods. The production time of Customerized products are expressed approximately by the Work-meter on the Website. At these times must be added the time of delivery, exclusive liability of the Courier.
ARMATEK Custom Lures Engineering confirms the assignment of the order to the Courier by sending an e-mail to the Customer.
Nota bene
All orders containing both products in stock and Customerized products (Custom and/or Ready Made) follow the time of assignment to the Courier of the latter.
Times, types and delivery costs
Crono International Delivery – Poste Italiane
It is a delivery made on any Business Day, from Monday to Friday, from 08.30 to 18.00. Exclusively on European Union territory and in the following coutries: Iceland, Liechtenstein, Norway, Switzerland, U.S.A., Japan, Canada.
The following locations are not served: Azores (PT), Balearic Islands (ES), Canary Islands (ES), Madeira (PT).
Crono International is a service that does not provide for multiple-piece shipments.
This type provides for the door-to-door delivery for all products.
The first delivery attempt is made approximately in 3/5 working days. Delivery times vary according to the location of departure and arrival of the shipment.
The service enjoys the Smart Alert system that informs on the status of the consignment, by sending an e-mail for free.
All orders with Crono International delivery are entrusted to the Courier Poste Italiane - SDA.
In the case of standard delivery made by the Courier Poste - SDA, the first delivery is carried out without notice. In the absence of the Customer the Courier leaves a notice (slip in the mailbox or sticker on the bell) and retries the delivery on the Business Day following the failed delivery. In case of further absence even on the second try, the courier will leave a notice of stocks with references at the Post Office where the recipient can pick up the shipment in the next 10 working days, including Saturdays, starting to run on the working day following the date of the second delivery attempt, as indicated on the second notice. In this case the storage service is for free.
Upon delivery, the shipment is entrusted to the recipient or a person authorized to retire (member of the household, partner, family helper, and person involved in the distribution of mail in the building), who must sign it in full.
In case of non-delivery (by recipient unavailable, insufficient address, incorrect address, nonexistent address, unknown recipient, died or moved, delivery rejected by the recipient) and in case of non-collection by the recipient, the shipment will be back to ARMATEK Custom Lures Engineering, resulting in the order cancellation and subsequent refund depending on payment method chosen. The aforementioned refund will be subjected to a deduction of the amount equal to the costs of delivery, as well as the fee of € 22.00 (including VAT) per waybill, to cover the expenses of storage service at the Post Office and the redelivery fee. For purchases made by bank transfer ARMATEK Custom Lures Engineering refunds by bank transfer, retaining € 1.00 (including VAT) to cover the cost incurred for bank charges. For purchases made by payment by credit card the refund will be made through a transfer of the transaction directly on the credit card, less the value of 2.0% (including VAT) of the entire amount transacted by the Customer, covering the cost incurred for bank charges.
Exceptions are orders containing Customerized products (marked on the site as Custom and/or Ready Made), for which there is no refund.
Delivery costs
The delivery costs are calculated automatically according to the weight (to be understood as actual weight) of the packed product and the destination zone, as indicated in the following table:

Complaints
Any claims related to the delivery of the products and their characteristics at the time of delivery must be reported to ARMATEK Custom Lures Engineering with one of the following ways:
Damaged products or mismatch of packages: any external damage or the mismatch in the number of packages should be immediately reported to the Courier and also reported to ARMATEK Custom Lures Engineering within eight (8) days through the means listed above.
Any no apparent damage discovered after the delivery of the products must be reported to ARMATEK Custom Lures Engineering within eight (8) days of their discovery.
Delivery delays: the complaints may be reported within six (6) days from the non-receipt with respect to the day of delivery or, if the product has been delivered, the same day of delivery.
Claims must include a description of their subject and the reasons on which they are founded.
ARMATEK Custom Lures Engineering is not responsible in case of non-performance of the service, delay, loss, partial or total damage, tampering of mail and for any other reason attributable to the Italian Post Office - SDA and/or resulting from access to service from unauthorized third parties. In accordance with Art. 63 of Legislative Decree no. 21/2014, the risk of loss or damage to goods, for reasons not attributable to the seller, is transferred to the Consumer when the Consumer or a third party, other than the Courier, enters physically in possession of the goods. The rights of the consumer against the Courier remain valid.
14. Withdrawal of the goods at the laboratory
Customers can collect the goods at the Laboratory of ARMATEK Custom Lures Engineering in Business Days from Monday to Friday , from 14.30 to 19.00. The goods can be collected directly from the Customer or a third party designated by them, presenting the invoice, and exclusively outside of the business premises, on the street. With the pick up at the workshop the Customer will not be charged any shipping cost. It is still required to pay the charge of € 3.00 (excluding VAT) to cover administrative costs, packing and CONAI contribution, supported by ARMATEK Custom Lures Engineering.
15. Right of withdrawal
E-commerce sales are regulated in Articles 52 to 59 (" distance contracts ") of Legislative Decree no. 21/2014 (Consumer Code). This legislation provides for the Consumer the right to terminate the contract or proposed contract, guaranteeing the right to return the product purchased and the reimbursement of expenses incurred.
The right of withdrawal does not apply to Customerized products (marked on the site as Custom and/or Ready Made), ordered by the Consumer (Art. 59, paragraph C of the Legislative Decree no. 21/2014).
The right of withdrawal cannot be exercised if the product is not intact, that is:
The withdrawal right is reserved exclusively for Consumers (individuals who purchase goods for purposes not related to his profession, trade or business), so it cannot be exercised by legal persons and natural persons acting for purposes related to the professional activity.
The costs of returning the product are paid by the Customer.
The risk of loss or damage to the goods are borne by the Customer.
The exercise of the right of withdrawal shall terminate the obligations of the parties to perform the distance contract.
Methods and timing for the exercise of withdrawal rights
To exercise the right of withdrawal is necessary to communicate to ARMATEK Custom Lures Engineering, within fourteen (14) days of receipt of goods, the will to terminate the contract as follows:

The Customer undertakes to return the goods without undue delay and in any event within fourteen (14) days from the date on which he/she communicates to ARMATEK Custom Lures Engineering his/her decision to terminate the contract. The deadline is met if the consumer sends back the goods before the expiration of the fourteen (14) days period. The goods will be carefully packaged in a new box and returned in original packaging, complete with all accessories, instruction manuals and everything in origin content.
The Customer is still liable for any diminished value of the goods resulting from a different handling than what is necessary to assess the nature, functionality and features. If such manipulation exists, ARMATEK Custom Lures Engineering will retain an amount equal to 33% of the purchase value (goods only, shipping excluded) in the costs refundable to the Consumer.
Mode and timing of refund
ARMATEK Custom Lures Engineering will refund within fourteen (14) days from the date it became aware of the withdrawal right by the Customer. In the event that the product has already been delivered to the customer, ARMATEK Custom Lures Engineering will refund the Customer only following the successful return of the products and the integrity verification of the same.
For purchases made by bank transfer ARMATEK Custom Lures Engineering reimburse by bank transfer, retaining € 1.00 (including VAT) to cover the cost incurred for bank charges.
For purchases made by payment by credit card the refund will be made through a transfer of the transaction directly on the credit card, less the value of 2.0% (including VAT) of the entire transacted amount from Customer, covering the cost incurred for bank charges.
The shipping charges incurred by ARMATEK Custom Lures Engineering for delivering the goods to the Customer will not be refunded.
16. Legal Guarantee
Pursuant to Legislative Decree 206/2005 ("Consumer Code ") all the products for sale on the Website are covered by the Legal Warranty of 24 months.
According to the 24-month Legal Warranty, ARMATEK Custom Lures Engineering is responsible to the Consumer (a natural person who do not acts for purposes of trade, business, craft or profession) for any lack of conformity of the product that is not evident at the time of purchase.

The lack of conformity which becomes apparent within 24 months from the date of purchase of the goods must be reported within 2 months after the date of discovery of the defect.
Unless proved otherwise, it is assumed that any lack of conformity occurring within 6 months after delivery of the goods already existed on that date. In case of lack of conformity, the consumer has the right to restore, without charge, the conformity by repair or replacement (Art. 130 of the Consumer Code). The consumer may, at its option, ask the seller to repair the goods or to replace them, at no charge in both cases, unless the remedy requested is impossible or disproportionate to the other. Any repair or replacement shall be completed within a reasonable time from the request of the Consumer; the average time of delivery to the Consumer of the product is twenty-four (24) days. If within the period up to sixty (60) days ARMATEK Custom Lures is unable to return the product repaired, the Consumer may request one of the alternative remedies (replacement, cancellation of the contract, price reduction).
